Beginning on May 1, 2015, USGovBid is implementing a refundable deposit to register. All new online Bidders will be required to make a $100 deposit via PayPal to bid on our government online auctions. The $100 deposit includes a $45 one-time online registration process and $5 PayPal fee (includes to verify the IP address, phone numbers, emails, etc). As long as a Bidder is not actively bidding on an auction and does not owe any outstanding payments, the Bidder may request by an email sent to USGovBid at info@usgovbid.com, a refund of the remaining deposit ($50). At that point, their bidding number will be turned off and bidding privileges will be removed. For refunds of deposits paid via PayPal, USGovBid will process the Bidder’s refund back to the Bidder via PayPal within 15 days of receipt of the request. The refundable deposit is non-transferable to auction payments or late fees. There will be absolutely NO REFUNDS for payment defaults, late payments or late removals.

Bidder and Auctioneer agree that the terms listed below shall govern the online auction sale.
All bidders participating in this auction agree that they have read and fully understand these terms and agree to be bound thereby. All bidders are required to electronically create an account for bidding on this site. All account information the Bidder provides to the Auctioneer shall be current, complete and accurate. Bidders must be 18 years of age or older. If applicable, State and local Sales tax will be charged unless the auctioneer is presented with a valid exempt use or resale certificate. All sales are subject to appropriate State Tax Laws; Buyer must acknowledge and agree not to retract the purchase offer.
When Bidder places a bid on an auction being operated by Auction Liquidation Services; Bidder is entering into a contractual agreement with the Owner/Seller. Therefore, unless Bidder intends on being legally obligated to purchase the item(s) on which Bidder places a bid, Bidder should not place the bid. If Bidder does place a bid and fails to comply with the contractual agreement, Bidder agrees to be subject to the laws of the State of New Jersey, County of Monmouth. All bids are binding, even if outbid, until the transaction of the highest legitimate bidder is completed with the Seller/Owner. In the case that the highest bid is considered fraudulent or the high bidder defaults on their bid, the Owner/Seller will have the option of either selling to the next highest bidder, or canceling the auction. Auctions which close with a bid that is below the Reserve Price of an auction are the only exception to this policy, in which case neither the Owner/Seller nor the Bidder are obligated to complete the transaction normally.

We have a feature called extended bidding. This feature will leave the bidding open for 3 minutes on any item that has received a bid within the last minute from the last recorded bid time, even if the the ending time has been reached. This feature has been added to eliminate sniping and to make the online bidding process more like a ‘live’ auction.
All bidders understand that all high bids for items up for auction are subject to Seller’s confirmation. The high bidder will be the next business day of the Sellers confirmation. All payments must be made within 24 hours by Wire Transfer or overnight Cashier’s Check to Auction Liquidation Services, 300 Commerce Drive, 1st Floor, Tinton Falls, NJ 07753.
If the winning bidder fails to pay the purchase price and other associated fees before the payment deadline then the winning bidder must pay to Auction Liquidation Services a late fee equal to 2% of the purchase price. If the winning bidder fails to make full payment of the purchase price and other fees within five (5) days after the auction, such winning bidder shall be deemed in default of its obligations in connection with the bid and shall forfeit its rights to purchase the goods, in which case the Seller may sell the goods to another bidder. If the winning bidder is in default as set forth herein, a Default Penalty will be assessed to the winning bidder in the amount of $1,500 or the dollar amount of the invoice, whichever is less, and the winning bidder will be barred from bidding on other auctions on the marketplace until the Default Penalty is paid. The Bidder will also have to pay a $250.00 non returnable fee to Auction List Services to be able to be allowed to have the privilege of bidding again. The Default Penalty must be paid to Auction Liquidation Services by cashier’s check or wire transfer. In the event of a default as set forth in these Terms and Conditions and as is allowable in accordance with the laws of the State of New Jersey, the winning bidder may be subject to other claims, damages or liabilities to the Seller and/or Auction Liquidation Services.
The high biddder is leaving their item at their own risk. The Auctioneer/Auction Site is not responsible for damaged or stolen property. No adjustments will be made. We encourage immediate removal of your items after payment.
There will be NO WEEKEND releases. After the final removal date there will be a storage fee charged to the Buyer. If merchandise is not removed within 10 days of the final removal date, the ownership of the merchandise will revert back to the original Owner/Seller. The Owner has the right to sue for collection of such charges. Merchandise becomes the full responsibility of the Buyer at the time the Buyer takes possession and Buyer assumes all risk of loss and damage to property at that time.
The descriptions of item/lots appearing in the auction and in advertising prior to the auction are believed to be correct. Nevertheless, the Auctioneer is not responsible for the correct description, year, make, model, VIN#, mileage, authenticity, genuineness or defects in any lot and makes no warranty. Auctioneer is not responsible for any items that are removed from law enforcement or county service vehicles by said law enforcement agency or County. ALL SALES ARE FINAL. No deduction will be allowed on damaged articles as all goods being exposed for public auction are sold “as is – where is” and with all faults. Bidder acknowledges that all item/lots were available for inspection prior to the auction and the Auctioneer and Owner/Seller strongly encourages the Bidder to carefully inspect each item/lot in which the Bidder has any interest to determine the item/lots condition, quality and size. Bidder relied solely on personal inspection and not on information listed on the Site or otherwise provided by Auctioneer or Owner/Seller. Bidder’s failure to inspect or to be fully informed will not constitute grounds for any claim, adjustment, and refund, termination of the contract for sale or refusal to close the sale, against Auctioneer or Owner/Seller.
Auctioneer is providing services as an independent contractor for the Owner/Seller only and is not responsible for statements made by other parties.
Auctioneer cannot and will not be held responsible for any interruption in service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free services or use of the Site. Bidder acknowledges that the auction is conducted electronically and relies on hardware and software that may malfunction without warning. The Auctioneer, in its sole discretion, may void any sale, temporarily suspend bidding and re-sell any item/lots that were affected by any malfunction. The decision of the Auctioneer is final.
Auctioneer gathers information about Bidders and Owner/Sellers for the purposes of conducting online auctions. Auctioneer does not sell or rent this information.
