NOTICE: All bidders and other persons attending this sale agree that they have read and have full knowledge of these terms and agree to be bound thereby.

BIDDER: All bidders are bound by their signature on the Bidder’s Registration. Please read these terms carefully. Auctioneer reserves the right to refuse any applicant for a bidding card, or the privilege of bidding at this auction and to revoke such privilege at any time.

AGENCY: The auctioneer is acting only as agent only and is not responsible for the acts of its principals or consignors.

CONDITION OF ARTICLES SOLD: The auctioneer is not responsible for the correct description, genuineness, authenticity of, or defects in any lot, and makes no warranty in connection therewith. No sale will be set aside for allowance made on account of any incorrectness, error in cataloging, or any imperfection not noted. No deduction allowed on damaged articles, all goods being exposed for public exhibition, and sold “as is” and without recourse. Some items may be added or deleted without notice.

THIS LISTING IS ONLY A GUIDE AND MAY NOT BE ACCURATE IN EVERY WAY. EVERY ITEM WILL SELL “AS IS – WHERE IS”. PLEASE INSPECT THE EQUIPMENT PRIOR TO BIDDING. ALL SALES ARE FINAL.

TERMS – You must be 18 years old to register and present a valid driver’s license. Payment for all items must be made IN FULL on sale day in cash, certified check or check with bank letter of credit. Checks are to be made payable to South Jersey Transportation Authority. At the time of complete settlement you will receive a paid sales receipt. You must present paid receipt for release of equipment from the sale site. The Auctioneer reserves the right to reject any bid or bidder in the best interest of the Seller.

DISPUTE BETWEEN BIDDERS: If any dispute arises between two or more bidders the auctioneer may decide the same or put the lot up for sale again at once, and resell the highest bidder. The auctioneer’s decision shall be final and absolute. At knockdown (when it is sold to the highest bidder) the equipment or vehicle becomes the sole responsibility of the new purchaser.

RECORD: The record of sale kept by the auctioneer and bookkeeper will be taken as final in the event of any dispute.

REMOVAL:  All purchases MUST be removed by 3:00pm on Wednesday, September 21, 2011. No lot can, on any account, be removed during the sale. Removal shall be at the expense, risk and liability of the purchaser. Purchases will be released only on presentation of paid bill. Buyer is responsible for removing and loading of equipment purchased.

General Statement – Warranty and Conditions

ALL VEHICLES AND ITEMS ARE BEING SOLD “AS IS” – “WHERE IS”

All vehicles and items are being sold AS IS – WHERE IS. There is no warranty, expressed written or implied. There is no warranty of merchantability or warranty of fitness. The seller shall not be responsible for descriptions, authenticity, genuineness, condition or defects of vehicle, and make no warranty in connection with the vehicle, its description, authenticity, fitness, condition or defects. No allowance shall be made on account of any incorrectness, imperfection, defect or damage. Any description or representations are for identification only and are not to be construed as a warranty of any type. The Seller shall not provide any independent mechanic, appraisal or other inspection report. It is the responsibility of the buyer to have thoroughly inspected the vehicle and to have satisfied himself or herself as the condition and value and to bid based upon that judgment solely. The seller will make every reasonable effort to disclose any known defects associated with a vehicle at the buyer’s request prior to the final sale. Seller will make no repairs to the vehicle or item. Seller assumes no responsibility for any oral statement about the vehicle. Buyer shall assume responsibility for the vehicle at the point of sale.

Unless buyer is a licensed dealer, vehicle must be towed or motor shipped from vehicle location unless buyer obtains registration and insurance proof for specified vehicle prior to driving vehicle from stored location.

Seller will only accept cash, a certified check or check with a bank letter of credit made payable to South Jersey Transportation Authority. Buyer is responsible for all taxes, registration fees, and other extra costs such as transport and transfer of ownership.
