NOTICE: All bidders and other persons attending this sale agree that they have read and have full knowledge of these terms and agree to be bound thereby.

BIDDER acknowledges that an auction site is a potentially hazardous area. Every person at the auction site before, during and after the auction sale shall be deemed to be there at his own risk. NOTE: All bidders are bound by their signature on the Bidder’s Registration. Please read these Terms carefully. Auctioneer reserves the right to refuse any applicant for a bidding card, or the privilege of bidding at this auction and to revoke such privilege at any time.

AGENCY: The Auctioneer is acting as agent only and is not responsible for the acts of its principals or consignors.

CONDITION OF ARTICLES SOLD: The auctioneer is not responsible for the correct description, genuineness, authenticity of, or defects in any lot, and makes no warranty in connection therewith. No sale will be set aside for allowance made on account of any incorrectness, error in cataloging, or any imperfection not noted. No deduction allowed on damaged articles, all goods being exposed for public exhibition, and sold “as is” and without recourse. Some items may be added or deleted without notice.

THIS LISTING IS ONLY A GUIDE AND MAY NOT BE ACCURATE IN ANY WAY. EVERY ITEM WILL SELL “AS IS – WHERE IS”. PLEASE INSPECT THE EQUIPMENT PRIOR TO BIDDING. ALL SALES ARE FINAL.

TERMS - You must be 18 years old to register and present a valid driver’s license. Payment for all items must be made IN FULL ON Sale Day in Cash, Cashier’s Check or Company Check accompanied by a current Bank Letter guaranteeing payment to County of Union. At the time of complete settlement you will receive a paid sale receipt. You or your trucker must present paid receipt for release of equipment from the sale site. The Auctioneer reserves the right to reject any bid or bidder in the best interest of the Seller. SOME ITEMS MAY BE SUBJECT TO CONFIRMATION.

AUCTIONEER IS NOT RESPONSIBLE FOR STOLEN OR DAMAGED LOTS PRIOR TO OR AFTER SALE. IT IS THE SOLE RESPONSIBILTIY OF THE BUYER TO SECURE THEIR ITEMS**

SALES TAX: There is 7% Sales Tax where applicable. In the event the New Jersey State Division of Taxation deems the entire sale taxable, the buyer is responsible for the tax due on his purchases.

DISPUTE BETWEEN BIDDERS: If any dispute arises between two or more bidders the auctioneer may decide the same or put the lot up for sale again at once, and resell to the highest bidder. The auctioneer’s decision shall be final and absolute. At knockdown (when it is sold to a high bidder) the equipment or vehicle becomes the sole responsibility of the new purchaser.

RECORD: The record of sale kept by the auctioneer and bookkeeper will be taken as final in the event of any dispute.

REMOVAL: All purchases must be removed by October 18, 2010 by 4pm. No lot can, on any account, be removed during the sale. Removal shall be at the expense, risk and liability of the purchaser. Purchases will be released only on presentation of paid bill. Buyer is responsible for removing and loading of equipment purchased.
